Protection of the producer of salads TM "Green bed" in a dispute with the State Labor Office on the imposition of a fine for unemployed workers
After an inspection visit, the State Labor Service imposed a fine on our client - LLC "EVK-Ukraine" for allegedly unregistered employees. The court of first instance refused to satisfy the company's claim. Bargen law firm joined the case at the appeal stage. However, the appellate court also rejected the appeal.
Our lawyers filed a cassation appeal, in which they substantiated the numerous violations committed by the courts during the consideration of the case. The Supreme Court by its ruling satisfied the cassation appeal of EVK-Ukraine LLC and referred the case for retrial. During the re-examination, the court of first instance overturned the decision of the State Labor Service to impose a fine on our client. After canceling the decision, we initiated another dispute about returning to the client the amount of the fine collected from him. The court satisfied our claim and returned the funds to the client.
