Legal defence of the leaseholder's client in a dispute with shopping mall
Our customer has rented a space at the Caravan Shopping Mall for selling mobile phone accessories. Following a confrontation with the administration, security at the mall took all the client's personal belongings and income and blocked the employee's access to his workstation. The client made the decision to terminate the dispute.
But a year and a half later, the Caravan Shopping Mall filed an appeal before the court with a claim of 300,000 UAH from the client for rent. In their opinion, the customer had to pay for the rented space even after being evicted.
We have proven to the court that our client does not have to pay all the time that he could not use the space. The local Court of Commerce and Appeal accepted our arguments and dismissed the complaint of the Caravan Shopping Mall.
