El motivo es la violaci\u00f3n por parte del fiscal del per\u00edodo de investigaci\u00f3n previa al juicio. En este caso, el fiscal viol\u00f3 el per\u00edodo de investigaci\u00f3n previa al juicio y envi\u00f3 auto de acusaci\u00f3n fuera del per\u00edodo de investigaci\u00f3n.<\/span><\/p><p><span style=\"color: #000000;\">Ten\u00edamos una opci\u00f3n: solicitar la absoluci\u00f3n o exigir el cierre del caso por violaci\u00f3n del per\u00edodo de investigaci\u00f3n. <strong>Justificante<\/strong> - Este es un juego largo, se necesitan varios a\u00f1os para completar las 3 instancias. Adem\u00e1s, no hab\u00eda garant\u00edas de que hubiera una absoluci\u00f3n o que no fuera revocada por uno de los tribunales.<\/span><\/p><p><span style=\"color: #000000;\">Antes del debate, decidieron tomar un camino m\u00e1s f\u00e1cil y presentaron una moci\u00f3n para cerrar el proceso penal. El tribunal accedi\u00f3 a la solicitud y se cerr\u00f3 el caso.<\/span><\/p><h4 style=\"text-align: center;\"><span style=\"color: #000000;\"><strong>\u00bfC\u00f3mo cerrar el caso por violaci\u00f3n de los t\u00e9rminos de la instrucci\u00f3n?<\/strong><\/span><\/h4><p><span style=\"color: #000000;\">La investigaci\u00f3n previa al juicio es una etapa del proceso penal que comienza con el ingreso de informaci\u00f3n sobre un delito penal en el Registro Unificado de Averiguaciones Previas al Juicio y finaliza con el cierre del proceso penal o el env\u00edo de una acusaci\u00f3n al tribunal.<\/span><\/p><p><span style=\"color: #000000;\">La investigaci\u00f3n previa al juicio debe completarse. <strong>dentro de los 2 meses siguientes a la fecha de notificaci\u00f3n a una persona de la sospecha de haber cometido un delito. <\/strong><\/span><\/p><p><span style=\"color: #000000;\">El proceso penal se cierra si <strong>despu\u00e9s de la notificaci\u00f3n a la persona sobre la sospecha, el plazo de la investigaci\u00f3n previa al juicio ha expirado<\/strong>, definido por el art\u00edculo 219 de este C\u00f3digo, salvo el caso de notificaci\u00f3n a una persona de la sospecha de haber cometido un delito grave o especialmente grave contra la vida y la salud de una persona.<\/span><\/p><p><span style=\"color: #000000;\">La pr\u00e1ctica judicial actual de la Corte Suprema sugiere que dentro del per\u00edodo de instrucci\u00f3n <strong>la acusaci\u00f3n no s\u00f3lo debe redactarse, aprobarse y notificarse, sino tambi\u00e9n enviarse directamente a la direcci\u00f3n del tribunal<\/strong>.<\/span><\/p><p><span style=\"color: #000000;\">As\u00ed, para calcular el plazo de la instrucci\u00f3n, tomamos la fecha de notificaci\u00f3n de la sospecha y la fecha de env\u00edo directo de la acusaci\u00f3n al tribunal.<\/span><\/p><p><span style=\"color: #000000;\">Si el per\u00edodo entre estas fechas excede el per\u00edodo de la investigaci\u00f3n preliminar (un m\u00ednimo de 60 d\u00edas o el per\u00edodo por el cual el tribunal prorrog\u00f3 la investigaci\u00f3n preliminar), entonces hay motivos para que el tribunal cierre el proceso penal.<\/span><\/p><h4 style=\"text-align: center;\"><span style=\"color: #000000;\"><strong>\u00bfCu\u00e1les son las consecuencias de cerrar un proceso penal por violaci\u00f3n del per\u00edodo de instrucci\u00f3n?<\/strong><\/span><\/h4><p><span style=\"color: #000000;\">El tribunal dicta la decisi\u00f3n de cerrar el proceso penal. Al mismo tiempo, el tribunal no examina las pruebas y no decide sobre la culpabilidad o inocencia de una persona.<\/span><\/p><h4 style=\"text-align: center;\"><span style=\"color: #000000;\"><strong>\u00bfEn qu\u00e9 etapa puede el tribunal decidir sobre el archivo del proceso por incumplimiento del per\u00edodo de investigaci\u00f3n?<\/strong><\/span><\/h4><p><span style=\"color: #000000;\">Esto se prev\u00e9 directamente en la etapa de la audiencia preparatoria, pero no existen restricciones para cerrar el proceso penal durante el juicio. Por lo tanto, el tribunal puede cerrar el caso en cualquier etapa, pero antes de que el tribunal debata el caso. As\u00ed lo confirma la pr\u00e1ctica judicial.<\/span><\/p><p><span style=\"color: #000000;\">La pr\u00e1ctica judicial de calcular los plazos procesales tambi\u00e9n fue se\u00f1alada a la atenci\u00f3n de los fiscales por la Fiscal\u00eda General en la carta informativa sobre las conclusiones jur\u00eddicas del Tribunal Supremo sobre el cumplimiento de los plazos procesales.<\/span><\/p><h4 style=\"text-align: center;\"><span style=\"color: #000000;\"><strong>\u00bfExiste una excepci\u00f3n a la categor\u00eda de procesos penales en la que el tribunal puede cerrar el caso?<\/strong><\/span><\/h4><p><span style=\"color: #000000;\">S\u00ed, el tribunal puede cerrar el caso, excepto en los casos de notificaci\u00f3n a una persona de la sospecha de haber cometido un delito grave o especialmente grave contra la vida y la salud de una persona.<\/span><\/p><p><span style=\"color: #000000;\"><strong>Conclusiones<\/strong>: si en su situaci\u00f3n se han violado los t\u00e9rminos de la investigaci\u00f3n previa al juicio, puede elegir qu\u00e9 camino proceder: cerrar el caso inmediatamente en el tribunal o llegar al final y exigir la absoluci\u00f3n.
