Consideremos con m\u00e1s detalle en este art\u00edculo.<\/span><\/p>\n<h4><span style=\"font-family: arial, helvetica, sans-serif; color: #000000;\"><strong><b>orden general<\/b><\/strong><\/span><\/h4>\n<p><span style=\"font-family: arial, helvetica, sans-serif; color: #000000;\">Para las tierras agr\u00edcolas, la persona que tiene un permiso especial para la extracci\u00f3n de minerales de importancia nacional tiene el derecho primario a comprar la parcela, y el arrendatario tiene la segunda prioridad. Al mismo tiempo, centraremos nuestra atenci\u00f3n en el arrendatario, como sujeto que tiene el derecho primario a adquirir terrenos de propiedad privada.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; color: #000000;\">Con derecho de tanteo, el arrendatario deber\u00e1 en todo caso pagar el precio al que se vende el terreno, y en caso de venta en subasta, su oferta debe ser igual a la oferta m\u00e1s alta ofrecida en la subasta. participantes.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; color: #000000;\">El propietario del terreno est\u00e1 obligado a registrar la intenci\u00f3n de vender el terreno en el Registro Estatal de Derechos Inmuebles a trav\u00e9s de un notario a m\u00e1s tardar 2 meses antes de la fecha de celebraci\u00f3n del contrato de venta del terreno. M\u00e1s o menos: una empresa cuyos participantes sean \u00fanicamente ciudadanos de Ucrania puede, por ley, poseer tierras agr\u00edcolas, pero la empresa ya posee una superficie total de 10.000 hect\u00e1reas, que es el m\u00e1ximo permitido.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; color: #000000;\">En este caso, el arrendatario puede transferir su derecho preferencial a comprar el terreno a otra persona que, seg\u00fan la ley, puede adquirir la propiedad de dicho terreno. <\/span><span style=\"font-family: arial, helvetica, sans-serif; color: #000000;\">La transferencia del derecho preferencial a la compra de un terreno se puede realizar tanto antes como despu\u00e9s del registro estatal de la intenci\u00f3n del propietario del terreno de venderlo. En este caso, esto debe hacerse a m\u00e1s tardar dentro de 1 mes despu\u00e9s de la notificaci\u00f3n por parte del notario sobre la venta de la parcela. <\/span><\/p>\n<h4><span style=\"font-family: arial, helvetica, sans-serif; color: #000000;\"><strong><b>El procedimiento para que el arrendatario transfiera el derecho de preferencia a otra persona:<\/b><\/strong><\/span><\/h4>\n<ol>\n<li><span style=\"font-family: arial, helvetica, sans-serif; color: #000000;\">Celebrar un acuerdo escrito sobre la transferencia del derecho preferencial con la persona a quien se transfiere dicho derecho. El contrato especifica el plazo por el cual se transfiere el derecho preferencial.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif; color: #000000;\">Inscribir dicho derecho en el Registro Estatal de Derechos Inmuebles.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif; color: #000000;\">Dentro de los 3 d\u00edas h\u00e1biles a partir de la fecha del registro estatal, notifique por escrito al propietario de la parcela sobre la transferencia del derecho preferencial. La notificaci\u00f3n se realiza mediante carta valiosa con descripci\u00f3n de los anexos y aviso de entrega o personalmente con recibo.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif; color: #000000;\">Si la parcela se vender\u00e1 en una subasta de terrenos, se deber\u00e1 notificar al organizador de la subasta de la misma manera a m\u00e1s tardar 5 d\u00edas h\u00e1biles antes del inicio de la subasta.<\/span><\/li>\n<\/ol>\n<p><span style=\"font-family: arial, helvetica, sans-serif; color: #000000;\">Al mismo tiempo, la persona a quien se le ha transferido el derecho preferencial a la compra de un terreno no puede transferir este derecho a otra persona.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; color: #000000;\">Este art\u00edculo establece un procedimiento general para el derecho preferencial a la compra de una parcela agr\u00edcola.
