Defense of a furniture manufacturer in a dispute with Kyiv Customs regarding the customs value of a furniture set
For the production of furniture in Ukraine, our client LLC "LHP Ukraine" (a subsidiary of the international manufacturer Leimholzprofi) imports a Turkish-made metal profile. During the customs clearance of the goods, the customs constantly adjusted the customs value of the goods. We appealed one of the customs' decisions to the court. While the court was considering the case, we accompanied the customs clearance of other consignments of goods and during each customs clearance we communicated with the customs and refuted all unreasonable claims of the customs regarding the client's documents. This is how our lawyers prepared an appropriate evidence base for a future appeal.
While the court appeal of one decision continued, we successfully appealed to the State Customs Service two decisions of the Kyiv Customs regarding two subsequent batches of the same goods of the client. Both during the court appeal and in the administrative procedure, we managed to prove the error of the customs' approach to comparing the value of the client's goods with the value of other furniture accessories, since such goods are completely different.
We also managed to justify the illegality and groundlessness of the customs' claims to the client's documents. As a result, all customs decisions were canceled.
