Protection of the interests of the creditor in the bankruptcy case of PJSC "MK "Azovstal" in the amount of more than 12 million hryvnias
Between our client LLC "ITR" and the debtor PJSC "MK "Azovstal" for a long time contractual relations existed regarding the supply of various construction mixtures. Over a certain period, the debtor incurred a debt of over 12 million hryvnias. The difficulty of proving this debt in court was that almost all of our client's primary documents under the contracts with the debtor were destroyed as a result of one of the air raids on the client's office located in occupied Mariupol. Yes, a small part of the goods and transport invoices, which we were able to present to the court, was preserved, but neither the contracts nor the expense invoices were preserved.
Our lawyers have collected all tax invoices for supplies between the parties, as well as the debtor's tax return for value added tax. Bargen lawyers analyzed the debtor's tax returns and compared them with the tax invoices, providing the court with detailed written explanations of all deliveries. The court recognized our client's monetary claims against the debtor in full.
