On October 1, 2023, the Law of Ukraine "On the Public Health System" (hereinafter referred to as the Law) entered into force. It establishes a system of measures to strengthen the health of the population and defines the list of competent bodies in the field of public health and their powers.
The law does not directly regulate the activities of business entities in relation to the production of products, but makes changes in the part of the permit documents necessary for the implementation of such activities.
Therefore, it will not be necessary to receive more conclusion of the state sanitary-epidemiological examination for sale and import of non-food products. This is due to the fact that the Law of Ukraine "On the Public Health System" repeals the Law of Ukraine "On Ensuring Sanitary and Epidemic Welfare of the Population", which provided for such an obligation.
For example, in the Law of Ukraine "On Pesticides and Agrochemicals" the provision on the need for a "positive conclusion of the state sanitary-epidemiological examination" for the registration of pesticides and agrochemicals will be excluded.
The initiators of the Law explain that such changes were necessary in order to bring Ukrainian legislation into line with European legislation and to facilitate the introduction of business in Ukraine. In the presence of a significant number of technical regulations that establish requirements for non-food products, the conclusion of the SES was an obstacle to economic activity, in particular, due to the long period of conducting research.
Also, on the basis of the Law, a permit document - a certificate of state registration of a hazardous factor related to chemicals and substances of biological origin - will be added to the list of documents of a permissive nature in the field of economic activity.
The law clearly states that its provisions do not apply to food products, except for those for which epidemiological investigations of diseases caused by infectious, non-infectious diseases are carried out.
At the same time, the order of such investigations is approved by the Cabinet of Ministers of Ukraine, and economic entities must ensure unimpeded access to the employees of disease control and prevention centers to the territories and premises of economic entities in order to respond to dangerous situations in the field of public health.
