Earlier, when buying a home for the first time, the buyer was forced to pay 1% of the cost of housing to the Pension Fund of Ukraine.
Without a receipt for payment of the pension fee, notaries did not certify the contract of sale of housing.
This situation was due to the fact that the government did not prescribe exactly how a notary should establish that a person buys a home for the first time.
After paying the fee, the buyer applied to the court to return the erroneously paid pension fee in connection with the purchase of housing for the first time.
Judicial practice shows that in most cases the court obliged the Pension Fund of Ukraine to return the erroneously paid pension fee. The courts base their decisions on the fact that the state should have provided a mechanism for exercising the buyer's right not to pay a pension fee when buying a home for the first time.
On September 23, 2020, the government amended the procedure for paying the pension fee and provided a mechanism for notaries to establish the purchase of housing for the first time.
In order not to pay the pension fee when buying a home for the first time you need:
write a statement to the notary about the absence of other real estate acquired through purchase, privatization, inheritance, gift;
provide a certificate from the State Register of Real Property Rights with a history of changes;
provide a certificate from the privatization department on non-use of housing checks for privatization of housing stock.
If you provide the above documents, the notary will not have the right to require you to receive a receipt for payment of the pension fee.
