The Law on the State Budget of Ukraine for 2022 was adopted

On January 1, the Law "On the State Budget of Ukraine for 2022" came into force. Now the minimum wage per month is 6,500 hryvnias, the subsistence level for able-bodied people will be 2,481 hryvnias.

Given that the law sets the minimum wage and subsistence level at the level envisaged from December 1, 2021, entrepreneurs will not experience significant changes yet. However, a further increase in these indicators will affect the increase in payments tied to them, in particular, the single tax rate and the minimum insurance contribution of SSC per month. Fines of many regulatory bodies are also tied to the minimum wage.

This affects the amount of court fees, the calculation of which is tied, in particular, to the subsistence level for able-bodied persons as of January 1 of this year.

From January 1, 2022, fines for violating the requirements for the use of RRO / PRRO increased

From January 1, 2022, the fine for violating the requirements for the use of RRO / PRRO was increased.

Thus, for the sale of goods without the use of PPO, non-issuance of a settlement document (check / receipt), sale of goods at a higher price than "passes" for PPO, fine - 100 percent of the value of goods sold in violation of this paragraph, if the violation is committed for the first time, 150 interest - if the second time. 

Previously, fines were 10 and 50 percent, respectively.

The Law on Tax Reform came into force on January 1

On January 1, Law № 1914-IX entered into force amending the Tax Code of Ukraine. The changes concern, in particular, general issues of tax administration, corporate income taxes, personal income, value added, excise and environmental taxes, rent, land fees, conditions of the simplified taxation system.

The law provides for many changes. Here are just a few examples:

  • the right is given to the controlling bodies to openly carry out sound recording, photo, video recording (video recording) during inspections;
  • taxpayers are released from the obligation to provide information at the request of the supervisory authority, if such documents have already been provided;
  • until January 1, 2027, the profits of agricultural producers engaged in certain activities, such as breeding and rearing poultry, with the exception of raising chickens, will be exempt from taxation;
  • a measure to repay the tax debt is introduced in the form of a temporary restriction on the travel abroad of the head of the legal entity - the debtor. Such a measure will be established by a court decision.
A law has been passed to abolish the marking of copies of audiovisual works by control marks 

On January 1, the Law came into force, which abolished the marking of copies of audiovisual works, phonograms, videograms, computer programs, and databases with control marks.

Right holders will now be able to choose the latest, more modern, individual (exclusive) ways to protect copies that are distributed on tangible media.

In this regard, the law also decriminalizes Art. 216 of the Criminal code of Ukraine which provided responsibility for illegal manufacturing, forgery, use of counterfeit control marks. Article 164-9 of the Code of Ukraine on Administrative Offenses, which provided for liability for the distribution of relevant goods, the packaging of which is not marked with control marks, was also excluded.

Urban conditions and restrictions can now be found in Action

On the "Action" portal you can now get urban planning conditions and restrictions - a document that contains requirements for construction projects and is obtained for the construction of apartment buildings and most industrial facilities.

Previously, in order to obtain town-planning conditions and restrictions, it was necessary to physically apply to the CNAP or a local authority. From the beginning of December 2021, it became possible to obtain town-planning conditions and restrictions through the Action.

The application for urban planning conditions and restrictions, formed in the Action, must be accompanied by scans of the necessary documents, namely:

- topographic and geodetic plan of construction;

- town-planning calculation, which determines the investment intentions of the customer, which is made in any form;

- scan of the document confirming the right of ownership of the land plot - in case the right of ownership of the land is not entered in the Register of real rights to immovable property.
